The state may refuse to grant a license if a student has been convicted of a crime; committed any act involving dishonesty, fraud, or deceit; or committed any act that the Texas Department of Licensing and Regulation (“TDLR”) considers grounds to deny licensure. TDLR denies licensure on the grounds that the applicant knowingly made a false statement of fact required to be revealed in the application for such license. Students who are not U.S. citizens or who do not have documented authority to work in the United States will not be eligible to apply to take the state licensure examination. It is the student’s responsibility to contact TDLR and determine whether your criminal background will hinder your ability to become licensed in the state. ISSUANCE OF INDIVIDUAL PRACTITIONER LICENSE.
The department shall issue an individual practitioner license to an applicant who:
(1) meets the applicable eligibility requirements;
(2) passes the applicable examination;
(3) pays the required fee;
(4) has not committed an act that constitutes a ground for denial of the license; and
(5) submits an application on a form prescribed by the department.
RENEWAL RULES.
(a) The commission by rule may establish requirements for the renewal of a license issued under this chapter, including continuing education requirements.
(b) The commission may establish separate requirements for:
(1) the initial renewal of a license; and
(2) subsequent renewals of a license.
(c) Before establishing continuing education requirements under this section, the commission must consider the potential impact of continuing education with respect to:
(1) identifying and assisting trafficked persons; and
(2) providing license holders with opportunities to acquire new skills.
